Kids need love of both parents

It is time for Michigan to recognize and for citizens to demand that there be a fundamental right to parent your children within our state's constitution and family law. I implore everyone to actively support both 2008-HJR-NN the "parental rights" resolution and HB 4564 the "equal parenting bill."

Children are a part of the family and they have the right to the love of both parents and their extended family too.  Allowing the state without due process of law through the courts and government child welfare bureaucracies to interrupt the child-parent relationship has destroyed many childhoods and caused untold damage to our society.  Parents should have the right to decide how their children are educated and medicated as long as there is no clear evidence that these choices will seriously harm their children. Allowing parents to raise children with their values and beliefs ensures a level of diversity that makes our society strong.

In an intact family children benefit from the love and care of two parents involved significantly in their life. The state and divorce/custody industry operators create opposing parents that clash, costing large sums of money and destroying the child-parent relationship in the supermajority of cases. The state is allowed through the supposed best interest of the child criteria to pressure most fathers to relinquish custody to the mother or be denied custody in court. The standard visitation schedule averages out to four to six days a month based on age of the child and will never be changed unless the parents agree or there is clear and convincing evidence of problems in the custodial home. HB 4564 and HJR-NN will help ensure that children will have the stability and love of both of their fit, willing and able parents.

Michigan House Bill 4564 - Ross Township Michigan Passes A Resolution In Support Of HB4564

Heather Mills continues her dig for gold in the Paul McCartney and Heather Mills divorce case.  Heather Mills turned down 30 million and just recently 100 million.  How long were they married?  Six years at most and Paul McCartney's fortune was made prior to his marriage to Heather Mills.

Like most men Paul McCartney will get screwed because he chose to have a child with Heather Mills.  Most child custody cases are awarded to the mother in the United Stated and in the United Kingdom.  Fathers4Justice has been working for years to change the biased family court systems in the UK.

The American Family Association of Michigan has confirmed their support for Michigan House Resolution NN (2008).

The AFA Michigan joins a growing coalition of both Michigan and National based organizations that support the many benefits of Michigan House Resolution NN (2008).

Michigan House Joint Resolution NN would lead to a constitutional amendment recognizing a parent's fundamental right to direct the care, education, and upbringing of their children. The context of this right is larger than just custody cases as it would apply to intact families and all sorts of scenarios (health care, educational & religious practices just to name a few).

House Concurrent Resolution 241 and Senate Concurrent Resolution 59

The United States House of Representatives and the United States Senate have introduced House Concurrent Resolution 241 and Senate Concurrent Resolution 59 respectively.  This is further proof that our elected officials are finally starting to hear our concerns.  House Concurrent Resolution 241 and Senate Concurrent Resolution 59 both express support for enacting joint custody laws for fit and willing parents.  This is another trend of positive news for those who want to end the current state of child abuse that is occuring all across the United States.

It is a child's fundamental right to be loved, guided, nurtured and educated EQUALLY by both fit and willing parents.  To deny this is wrong.  To deny this is CHILD ABUSE!  It is sad that some ex-spouses have learned to hate their ex more than they love their children.

Keep in mind that these are federal resolutions and will add further strength to state level bills such as Michigan House Bill 4564 and Michigan House Resolution NN (2008).  Remember our cause is justified and the moral one.

Legislation is just one way to obtain our goal.  Another is through litigation against every county and family court system in America.  An excellent example of this is the well organized United Civil Rights Councils of America which is planning a well coordinated class action lawsuit against every county in America.

Michigan activists are ON FIRE!  All across Michigan Equal Parenting Advocates are educating elected officials and Presidential candidates about the benefits of Equal Parenting Rights.  Delete of Michigan Father's Rights Coalition is seen below educating Mike Huckabee about how children benefit from equal parenting rights.  Delete was a critical part of the 2007 Equal Parenting Bike Trek.

Mike Saxton, a district advocate for A Child's Right and Dads and Moms of Michigan, spoke directly with Mike Huckabee.

Here is Mr. Saxton's account: "At a press conference today at Demmer Corp. in Lansing Michigan I had the opportunity to discuss shared parenting with Presidential candidate Mike Huckabee.

First I asked if he supported the proposed "Family Preservation and Reconciliation Act" to which he replied he was unfamiliar. I was able to provide him with volume 34 #3 of The Liberator which contains the text of the proposed Act and also a brochure from Dads & Moms of Michigan.

Second, I explained that there were over 1 million non-custodial parents in Michigan and over 25 million in the US; if you were elected President what would you do you ensure that children have equal access to both fit parents, regardless of marital status? He replied that he supports shared parenting.

Third, we discussed Michigan's shared parenting bill HB 4564 and I asked if he would endorse it. He replied that he hadn't read it but that he does support shared parenting. Rep. Rick Jones was also present at the press conference and in response to my request has forwarded a copy of HB 4564 to Governor Huckabee's office.

I suggest that we all ask our Representatives and Senators to ask the candidates their stance on shared parenting, and for an endorsement of our HB 4564, as they accompany them on the campaign trail. Please check the evening news for coverage of the press conference."

False Accusations of PPO violations and domestic violence are often used during child custody disputes as a way to remove the father permanently from his children.  This is common practice for certain women with personality disorders.  They learn to hate their ex-spouse more than they love their children.  To use this tactic is sick and another form of child abuse.

National Fatherhood Summit Jan 4 2008 - A smashing success!

The Media Coverage of the 2008 National Fatherhood Summit in Grand Rapids, MI was truly impressive! Four different TV News stations, 7 Radio Stations and 6 different newspaper reporters were present at this event! My husband, Robert Pedersen, was given a standing ovation for his efforts in promoting this event. It was incredible and I was so happy for him that I had to hold back my tears.

The energy level during the event was high!  The breakfast and lunch was excellent!  The networking was priceless!  The general opinion was that this event was outstanding and we had a full room! 

There were people from all over the United States!  Alabama, California, Maryland, Ohio, Pennsylvania - just to name a few.  Many different orgnizations were present at this oustanding event.

Minister Ronald Smith has clearly become a nationally known advocate and leader.  Special thanks for all of the work Children Need Both Parents, Inc put into this summit.

Denmark Makes Joint Custody Mandatory In Most Cases. America Supports Child Abuse.

America has an opportunity to learn from failures in Europe.  Many countries are creating mandatory joint custody (certain exclusions apply) laws and are becoming more family friendly.  Children have a fundamental, God-given right to be loved, educated, guided and nurtured by both fit and willing parents.  To deny this right is child abuse.

LAW SPARKS BOOM IN JOINT CUSTODY CASES

The legal system is preparing for a rush of fathers seeking joint custody of their children when revised parenting laws go into effect next week. The new parental law, which becomes valid on 1 October, is designed to give additional rights - and responsibilities - to both fathers and mothers. While current, decade-old legislation requires parents to reach an agreement before joint custody is granted, the new law establishes co-parenting as the norm - even after a divorce.

Under the new rules, joint custody can only be repealed if serious concerns for a child’s safety such as abuse come to light. The law requires that after a divorce, parents share a range of responsibilities ranging from taking children to school to ensuring the former spouse has information about school activities. Children themselves will also have more say under the legislation, as child welfare authorities will interview them on parental custody matters.

Experts are concerned, however, that the revisions could result in a flood of new law suits. Anja Cordes, chairman of the national organisation of lawyers dealing with custody cases, was a member of the committee, which drew up the law’s proposals. She stated that although the political will was in place to establish co-parenting after a failed marriage, feuding parents might lack the ability to put their differences behind them for the good of the child. ‘It will take time before parents learn to separate parenting with partnership and to stop seeking revenge through their child,’ she told Berlingske Tidende newspaper. She also predicted longer processing times for child welfare authorities in future cases, as parents who had lost custody cases in the past seek the chance to have their case retried. Anette Hummelshøj, the head of Department of Family Affairs, admitted the new law could place an additional strain on the legal system. ‘But our expectation is that when the courts have established a clear line for the legal area, a higher number of parents will be able to settle either inside or outside the courts.’

There will be several fund raising events to help A Child's Right raise the funds to fully complete our 501c3 application.  The process has already started but we will soon need additional funds to meet several federal requirements for a 501c3 non-profit corporation. 

2008 will be an exciting year for this organization.  In 2008 A Child's Right will also form a much closer alliance with Children Need Both Parents, Inc which is led by Minister Ronald Smith.  A Child's Right will also once again be a major supporter of the upcoming 2008 Equal Parenting Bike Trek.  There will be three cyclists this year:  Robb MacKenzie, Robert Pedersen and Attorney Brian Downs, Esq.  We are very confident that the 2008 Equal Parenting Bike Trek will obtain even more press and media coverage compared to the 2007 Equal Parenting Bike Trek!!  We were very impressed with the media coverage of the 2007 Equal Parenting Bike Trek.

Review by Economics Researcher: Taken into Custody

Good to see this excellent review of Stephen Baskerville's breakthrough book. I have also seen that people in the divorce "industry" itself, often judges, their government employees in the FOC and lawyers,  are really beat up about the injustice that they realize they are inflicting on fathers. The problem is, as this review points out, no one knows what to do about it. The machine has become too big. It now seems to have a momentum, a life, of its own. This is why we need to continue to inform others and implore them all to become politically active to rein in the power of the Divorce Industry to destroy the lives of parents and their children. Let’s use this review by sending it to your politicians and judges maybe even to some of your local lawyers out of the Yellow Pages along with yet another message to these folks for them to be champions of change.

Most Americans have made their peace with no-fault divorce, believing easy divorce to be an enhancement of individual liberty. But a new book by Stephen Baskerville argues that permitting unilateral divorce allows an unprecedented scope for government intrusion into ordinary people's lives. Taken Into Custody has several breakthrough insights.

First, no-fault divorce frequently means unilateral divorce: One party wants a divorce against the wishes of the other, who wants to stay married. This fact means that the divorce has to be enforced. The coercive machinery of the state is wheeled into action to separate the reluctantly divorced party from the joint assets of the marriage, typically the home and the children. Involving the family court in the minutiae of family life amounts to an unprecedented blurring of the boundaries between public and private life.

People under the jurisdiction of the family courts can have virtually all of their private lives subject to its scrutiny. If the courts are influenced by feminist ideology, that ideology can extend its reach into every bedroom and kitchen in America.

Thus, the social experiment of no-fault divorce, which was supposed to increase personal liberty has had the unintended consequence of empowering the state.

I had an unusual opportunity to see this first-hand last summer when I did a Continuing Legal Education workshop for judges. Most of the judges had significant experience with family courts, so they were unusually well-informed. My audiences are usually amazed when I point out that family courts perpetrate greater invasions of personal privacy than any other governmental agency. Not the judges. I had expected some resistance from them on this point. After all, they are the ones doing the intruding.

When I ran through my usual litany of courts telling fathers how much money they have to spend, how little time they get to spend with their kids and who gets to spend Christmas Day with the kids, the judges were all shaking their heads. I asked: "So, do you enjoy that part of your jobs?" The audible moaning said it all: They hate that part of their jobs.

Audiences are sometimes surprised to learn that women initiate most divorces. They are even more surprised when I tell them that women aren't necessarily worse off economically after divorce. After all, "the most quoted demographic statistic of the 1980s" was the claim that women's standard of living falls by 73% after divorce, while men's rises by 42%.

I usually have to take some time to refute that claim. But the judges already knew that. They all started shaking their heads when I flashed those statistics on the screen for the purpose of refuting them.

One of the judges got exasperated. He stood up and said, with obvious disgust in his voice, "These women want me to throw their husbands out of the house, make him pay child support, while she keeps the kids to raise herself without interference from him."

General nods of agreement all around the room.

No fathers' rights advocate could have said it better.

But fathers' rights advocate Stephen Baskerville has harsh words to say about the entire no-fault industry, including the judges. The court-appointed therapists, the domestic violence experts, the visitation supervisors, the teachers of parenting classes, all these experts seem to be there to help divorcing families. But on Baskerville's telling, they simply extract additional payments from the family, and do nothing to save the marriage.

He reports that even mediators find that they are not allowed to try to preserve the marriage. Their role is simply to talk the reluctant party into acquiescing. Baskerville represents all these professionals, including the lawyers and judges, as having a self-interested motive in stoking the flames of personal resentments and maintaining the divorce industry.

What then, of my judges, who were obviously disgusted with the system and their role in it?

I have also talked to many family law attorneys who are fed up with narcissistic and myopic clients. How can it be that all these people are keeping the system going out of their own self-interest, and yet profess disdain for that same system?

I think the answer lies in what economists call perverse incentives.

No one likes the actual outcome of the system, but no one has an incentive or the ability to change it. So people go along, following the rules as laid down, trying to make marginal improvements to the best of their ability, and still being sickened by the whole sight. The incentives are so perverse that it is as if everyone were motivated by a desire to create as many divorces as possible.

Baskerville has done a great service in laying out these twisted incentives in detail. I hope that family law practitioners will read this book with an open mind, and not take it personally when Baskerville accuses them of bad faith. He may be over the top about people's motivations. But his analysis is essentially correct.

The public is getting past the "happy talk" about "good divorces," because the children of divorce are finally telling their stories. We desperately need to get past our fatalism about the inevitability of divorce.

Taken Into Custody makes it crystal clear that the law has created incentives to divorce. Therefore, the law can be changed to reduce those incentives. The publication of Taken Into Custody could be the turning point in restoring some balance to family law. If you care about the condition of marriage in America, read this book.
