Parental and Civil Rights Alliance Launched by A Child's Right

A Child's Right recently launched the Parental and Civil Rights Alliance.  The rare opportunity to form a Meetup Alliance is by invite only and not open to the general public.  Quite the honor! In less than two days this Alliance already has 26 organizations that have joined with over 53,000 collective members!  Incredible results in a short period of time and we expect the Parental and Civil Rights Alliance to be listed in the Top 10 Largest Meetup Alliance list.

Pecuniary Interest

pe•cu•ni•ar•y / piˈkyoōnēˌerē/ • adj. formal of, relating to, or consisting of money: he admitted obtaining a pecuniary advantage by deception.

As a boy growing up in the 70’s, my father taught me a valuable lesson towards understanding, often times, the seemingly peculiar chain of events of an incident. He said,
“Just follow the money trail. Then you’ll know both why and what has and will happen.”
Sage words of wisdom from the “Ole man!” These words were not any more truthful then, than they are now!

As I progressed thru my divorce proceedings, ultimately believing the judicial system would soon discover the truth about myself- contrary to how my Ex portrayed me; the truth of my ability to raise my kids- contrary to how my Ex portrayed me; and, the truth of the need for my four young children to have both parents equally involved in their lives, I became disillusioned, contrary to my formerly held belief, over the continuous Orders rendered by the Court! First in its sole custody award to my Ex. Then, its outrageous child and spousal support awards- triple the state’s mandated formula. Finally, as a death knell, an order of visitation, with my kids, for only four days per month! There were no summer vacations, only six half days of holidays and not any time on their birthdays. I was devastated. I couldn’t believe it! I fought back, only to lose again, and again.

After my third stint in the county jail, for allegedly being in Contempt for support arrearages; I guess over 80% garnishment of my check was not enough; I began to research this obvious injustice from my father’s old adage- “follow the money trail.” I soon discovered my Court’s pecuniary interest in: Making me a non-custodial parent; Ordering support triple the state’s formula; Refusing to reduce my support despite proof of my wage; Illegally editing the Official Court Record; Repeatedly incarcerating me for alleged contempt; Refusing to provide me with a Court appointed attorney as an indigent; And, Worst of all, taking my kids away from me by suspending my parenting time!

The Court had developed a racket, a term commonly applied to syndicated crime families. The law had become the mob! Back in 1995, the Federal Legislature re-worded its laws for Welfare, Food Stamps, etc. The old wording was “a mother with child(ren) who has an absent father,” to the new wording, “non-custodial parent.” The seemingly innocuous re-wording was intended to defray the huge expenses the Feds were paying out to states in Food Stamps, Welfare, etc by incentivizing states to begin collecting child support from the absent father, now called the non-custodial parent. These, seemingly were the proper things to do. Why should children be allocated tax dollars for their care instead of parents paying to care for their own children? Ah, but we missed that third variable didn’t we? “The Federal Government wanted to incentivize the states.”

The states’ incentive is called Federal Title IV Block Grant Funding. The states receive funding from the Federal Government at a 2:1 match. (There are actually additional incentives for states beyond this figure tied to their performances) These block grants go straight to the County Court. Ah ha! My father was right! “Follow the money trail.” Now the injustices made sense. Now the kidnapping of my children made sense! Now the senseless incarcerations made sense. Now the erasing of Court documents made sense. Now the falsely claimed, irrationally applied, “Best Interest of the Children” made sense! Now the state’s hypocrisy made sense!

The next time you wander into a Family Court in MI and you hear a non-custodial parent attacking the court for its pecuniary interest, remember what my “ole man” said, “follow the money trail!” Sage advice for those of us who have children!

[W]hy then do parents who have NOT abandoned their child(ren) accept being classified as “non-custodial”???  Doesn’t accepting the label of “non-custodial” further the idea that legal positivism will be tolerated rather than attacked ferociously as well?

I agree with your implications. Legal Positivism is the denial of morality in law. While it might be argued not every law has moral implications (although I would present a different thesis), the legal positivist would assert no law has any moral implication. The law and morality are separately defined circles that never overlap. Our defense against legal positivism is founded in our basic assumptions. Or, as I am want of saying, our belief system!

That we the people, ever claim to have any rights must necessarily be derivative from an Authority. That we insist, that we have unalienable rights inherent within our beings, necessarily requires that those rights come both from said Authority and are also embodied within that said Authority, not the law. Otherwise, we begin down the slippery slope of relativism- non-absolutes. Thus, emerging with the reigning power self-granting its own authority- by law, according to its own agenda- sovereign’s will, to the degradation of the masses' once assumed unalienable rights, now absent Authority. The telos- The ultimate result, leads to totalitarianism!

One cannot insist he/ she has unalienable rights without granting that said unalienable rights are both embodied within and derivative from God! Once, we allowed the government to convince us that God was not allowed in the schools, thirty plus years ago, we began down the slippery road of relativism; Utilizing the replacement theology of existentialism; interpreting with the hermeneutic of modernism (and now post-modernism) resulting in the employed methodology of legal positivism to not only law, but also life. Absent of God, we have become absent of morality.

While woman for several decades have been moving their collective agendas through the legislatures and the courts, we men, more broadly IV-D and IV-E non-custodial victims, have nobody but ourselves to blame! We stood passive far too long ago, discharging our duty in the belief that- unalienable rights have no requisite in corresponding duties! Simple contract law asserts that "no right exists without a corresponding duty!" While assigning our duty to our elected officials we also, ignorantly, discharged our right to control government.

It is no wonder, within our ranks, that we see the evidences of our discharged duty. On the one hand, we have tyranny, ranging from ranting to, in some cases, full fledge gun assaults. On the other hand, we have tyranny's logical antithesis- apathy! Such has gathered us to this day!

Equal Parenting Cyclist Robert Pedersen - Front Page Detroit News, Mitch Albom Show, and the Dave Jaconette Show

Beyond Incredible!  Equal Parenting Cyclist, Co-founder of A Child's Right, DaddyBlogger and Detroit News featured fatherhood blogger Robert Pedersen made the FRONT PAGE of the Detroit News. This front page story with color photo was done by reporter Kim Kozlowski of the Detroit News.  This is Michigan's largest newspaper in the state of Michigan with overlapping coverage in Indiana and Ohio.  Circulation total is well over 300,000!

The article online also reached such popular demand that Detroit News placed in on their homepage and added additional online resources to the story.  They also linked to Robert Pedersen's blog with the Detroit News - he is one of their featured fatherhood bloggers.

The article by reporter Kim Kozlowski is still, after 24 hours in their most popular section on the homepage of the Detroit News.  With this success of this article Detroit News also conducted an online survey which is overwhelmingly in favor of shared parenting.

Today Robert Pedersen was also on the Mitch Albom Show which is nationally syndicated and has a massive audience in the state of Michigan.  Not only does Mitch have a popular radio show, but he is also author of many books such as Tuesdays with Morrie and is a frequent guest on shows like Oprah and more.

 

Prior to the Mitch Albom show Robert interviewed on the Dave Jaconette Show out of Kalamazoo.  Robert seemed very impressed with Jaconette's interviewing style.  We are hoping to get recordings of the interviews.

Michigan House Bill 4564 Testimony by Derek Bailey, MSW of Dance4Equaltiy

A Child's Right had the pleasure of urging Derek Bailey, MSW and Dance4Equality to attend the hearings for Michigan House Bill 4564.  American Indian Shared Parenting Organization, Dance4Equality was present outside of the House Building Office performing their spiritual dance in support of Michigan House Bill 4564.  Derek Bailey, Tonia Bailey, Robert Pedersen and myself (Angela) had an excellent time the night before the hearings learning much about the culture of Derek Bailey's tribe which is located in Michigan.  We experienced an amazing connection with the couple and are so proud to call them close friends.  To see some of the members of Dance4Equality walk into the hearing room was breathtaking to say the least!  A Child's Right is proudly affiliated with Dance4Equality.

Derek Bailey, MSW did an outstanding job outlining how shared parenting would positively impact his tribal community.  He also did an incredible job explaining his viewpoint as a state of Michigan licensed clinical social worker and MSW.  Dance4Equality CLEARLY "put themselves on the map" in Lansing as a leading shared parenting organization in Michigan.  There was a tremendous sense of pride by all who supported Michigan House Bill 4564 when Dance4Equality was present.

Can Women Rape Men?

Can Women Rape Men?  Is it even possible?  Sadly, some think that if the male had an erection he must have wanted it from the female and therefore could not be classified as rape.

Rape to a male by a female can occur if the male was unable or unwilling to consent to sex.  This can happen when they are 1) Under the age of consent (varies by state). 2) Handicapped or physically limited. 3) Impaired by alcohol or drugs.  4) Forced or coerced by a woman

Stimulation alone can cause a male to have an erection even if the stimulation is forced.  This is a scientific fact.  Males can have two types of erections psychogenic and reflex.  A reflex erection occurs when there is direct physical contact with the penis, ears, nipples or neck and is completely involuntary.  A reflex erection can occur without desire or sexual stimulating thoughts.  The ability to have this simple reflex is located in the sacral nerves (S2-S4) of the spinal cord.  Males can also become erect if they are on certain drugs or forced to take them.  They can also become erect by certain states of relaxation, anxiety, in certain stages of sleep, etc.

Review a compiled list by WND of the rape and/or sexual assault of over 100 males by females.

Sadly many males do not report that they were raped.   

Obviously any victim of rape should seek immediate medical and law enforcement help.

Parental Alienation Awareness Day is April 25th. Do You Know Someone Who Has Used This Form of Child Abuse?

Tomorrow you have a duty.  You have the responsibility of telling others that April 25 is Parental Alienation Awareness Day!  Parental Alienation is all too common now during and after divorces where children are involved.  Essentially the parent which attempts to alienate the other parent is too consumed in their hatred towards the ex-spouse to even realize the tremendous damage they are doing to their own children.  Parental Alienation can be subtle or openly pursued.  Mothers and Fathers can both be responsible for Parental Alienation.  They do not love their children enough to place aside their hatred towards their ex-spouse. 

Moms and Dads aren't the only ones which can use parental alienation tactics.  Grandparents can become child abusers as well by bad mouthing the father in front of the children.  It is all too common to find that they were responsible for parental alienation towards their own children if there was a divorce in the mix.  Sadly, they can shape their own children to be adults that use parental alienation tactics.  Children of divorce have already been through enough and will have many additional challenges just because of their parents getting a divorce.  Parents and grandparents should love their children/grandchildren enough to eliminate any form of parental alientaion.

Parental Alienation is indeed child abuse!  A few examples of Parental Alienation can be:  1)  Mom tells Dad he is a "deadbeat dad" in front of the children.  2)  Mom refuses to allow meaningful time for Dad to form an appropriate parent-child relationship which includes nuturing, educating, reading, loving, guiding, playing games and toys with the child, etc.  3)  Mom allows her friends that visit to speak poorly about the Dad in front of the children with no correction by Mom.  4)  Bad mouthing or undermining the other parent in front of the children.  5)  Mom tells children that Dad did not call when he actually did to say goodnight, talk briefly, etc.  To clarify again -  both genders are capable of parental alienation.

What are some warning signs of Parental Alienation?

-Children perceive one parent as causing financial problems of the other parent
-Children appear to have knowledge of details relating to the legal aspects of the divorce or separation
-Children show sudden negative change in their attitude toward a parent/guardian
-Children appear uneasy around target parent - they resort to "one word" answers and fail to engage openly in conversations as they previously have done
-Children are uncharacteristically rude and/or belligerent to target parent
-Access time is not occurring as agreed upon or court ordered - visitation is being unilaterally cut back by the other parent
-Hostile Aggressive Parent (HAP) parent undermines the other parent or speaks disparagingly about other parent in the presence of the children
-HAP parent starts making reference to other parent as being abusive and a risk to the children with no apparent good reason
-Allowing children to choose whether or not to visit a parent, even though the court has not empowered the parent or children to make that choice
-Telling the children about why the marriage failed and giving them the details about the divorce or separation settlement
-Refusing the other parent access to medical and school records or schedules of extracurricular activities
-Blaming the other parent for not having enough money, changes in lifestyle, or other problems in the children's presence
-Rigid enforcement of the visitation schedule for no good reason other than getting back at the other parent
-False allegations of sexual abuse, drug and alcohol use or other illegal activities by the other parent;
-Asks the children to choose one parent over the other
-Reminding the children that the children have good reason to feel angry toward their other parent;
-Setting up temptations that interfere with visitation
-Giving the children the impression that having a good time on a visit will hurt the parent;
-Asking the children about the other parent's personal life;
-'Rescuing' the children from the other parent when there is no danger.

Hopefully with films such as Jake's Closet, which we discussed in a prior post, more people will become aware of Parental Alienation and put a stop to it.

We first became aware of the movie called "Six" by Dr. Helen Smith when the Dr. wrote a blog post about the 2008 Family Preservation and Equal Parenting Bike Trek.  Exploring her blog further we came across this website dedicated to a movie called "Six".  Based on the trailers and the topic matter, we will be purchasing a copy of this movie in the very near future.

"On a sunny day on April 6, 1997, the Lillelid family met its death at the hands of a group of troubled teenagers from Kentucky. The Lillelids were Jehovah's Witnesses, fresh from a convention in Johnson City and anxious to win new converts for their faith. The teenagers were a group of outcasts from Pikeville, Kentucky, on the run after getting into trouble in their hometown"

According to the website for the movie, the film explores the roots of teenagers' violence, the failures of the authorities and social systems to address these problems.  We have not watched the movie yet and are looking forward to learning more about the circumstances that led to such a tragic ending.  We would have to guess that some of the teenagers did not have their fathers involved in their lives. 

Sadly, there are some fathers and mothers who do not want to be a part of their children's lives after a divorce.  On the other hand, there are mothers and fathers that are removed from an EQUAL parenting role in their children's lives based on the order of a family court judge.  In the later case, we have long advocated for shared or equal parenting.  Again, we do not know what the circumstances were that led up to such a violent and tragic ending and we look forward to purchasing this movie seeking answers to our questions.

When it comes to the divorce of two parents that have children people think of the two parents and the children in the middle of the divorce.

In order for the state and the court system to make money through Title IV-D federal incentives, one of the fit and willing parents must be forced into the role of the non-custodial parent.  Sadly, children go from seeing this parent on a daily basis and then suddenly the typical 4-6 days a month.  Children have the fundamental right to be loved, guided, nurtured and educated equally by both fit and willing parents after a divorce.  To deny this is child abuse.

The pain of this child abuse also affects the parents of the non-custodial parent.  Grandparents are then forced to see less of their grandchildren.  This is abusive not only to the children but to the grandparents as well.  Grandparents, from both sides of the family tree, play an important role in the development of their grandchildren.  How do grandparents in this situation deal with all of this pain?  The pain of seeing their child become a non-custodial parent and being forced away from their child by no choice of their own or the child's.  Grandparents must also endure the pain of seeing less of their own grandchildren.

Grandparent are increasingly becoming involved in the Shared Parenting movement and are joining in the fight against child abuse that is sponsored by a bitter spouse and the court system. 

I encourage all grandparents to visit SCOPE - Senior Citizens Organization for Parental Equality and become involved in what is in the best interest of their grandchildren.  Another organization that I can personally recommend is Three Sides to Every Story, Inc.  Grandparents!  There is a place for you to make a difference.

Michigan Shared Parenting Advocate Will Formally Announce his Candidacy for State Representative for the 43rd District Today.

Waterford, Michigan - February 25, 2008 -

On February 25, 2008 Scott Hudson of Waterford will formally announce his candidacy for State Representative for the 43rd District.

Hudson has already filed petitions to qualify for the open seat which represents all of Waterford, Lake Angelus, and the northwest portion of West Bloomfield, and is running as a Democrat.

The announcement will be made at the Oakland County courthouse auditorium at 1200 N. Telegraph, Pontiac at 7:30 p.m. during a meeting of the Family Rights Coalition. 

Hudson believes that the integrity of the family must be respected and that the role of the family in America is vital.  The mother and father both need equal and full access to their children, and that the role of the state must be secondary to children having both parents in their lives.

The economy of Michigan needs to be strengthened so that the security of the home and family is not placed in jeopardy because of loose lending practices.  Michigan manufacturing needs to be supported with initiatives that encourage private investment.  New and emerging technologies from the great and innovative minds of Michiganders need to be encouraged.  Partnerships need to be encouraged so that wasteful duplication does not overly tax the people.

Hudson has served eight years on the Board of Directors of an electric utility and understands that there are things that can be done to encourage private investment in sustainable power generation that creates new jobs.

Hudson was elected Vice-President of the Waterford School Board of Education in 2005 and understands that education needs a reliable funding source, and that teachers need to be supported. 

As a nine year member of the Waterford Planning Commission Hudson supports efforts to encourage walkability without raising taxes, and to encourage healthy lifestyles through education, and example.  The Summit Place Mall area needs to be supported through private enterprise and not with government subsidies. 

There is a need for judicial reform.  It is unfair that Oakland County picks and chooses who they fund in the district court system.  The taxpayers of the 43rd District pay such expenses while other governmental entities are subsidized.

Unfunded mandates from the State and Federal government should not be allowed.  Public safety and revenue sharing are very important matters and these must be provided for.

Heather Mills Continues Digging For Gold In Sir Paul McCartney Divorce Case

Heather Mills continues her dig for gold in the Paul McCartney and Heather Mills divorce case.  Heather Mills turned down 30 million and just recently 100 million.  How long were they married?  Six years at most and Paul McCartney's fortune was made prior to his marriage to Heather Mills.

Like most men Paul McCartney will get screwed because he chose to have a child with Heather Mills.  Most child custody cases are awarded to the mother in the United Stated and in the United Kingdom.  Fathers4Justice has been working for years to change the biased family court systems in the UK.
